Terms of service
These Terms of Use (the "Terms") are intended to govern your access to and use of the A1QuicK’s Flash mobile application ("Platform"). Please ensure that you read and understand these Terms before accessing or using the Platform.
By accessing the Platform, You are agreeing to these Terms and agree that these Terms constitute a legally binding agreement between You, whether personally (‘‘You”/‘‘Your”/‘‘Yourself”) and A1QuicK Private Limited and its affiliates (collectively, “A1QuicK”/ “We”) with respect to the use of Platform.
You shall not use the Platform if You do not accept the Terms or are unable to be bound by the Terms. Your use of the Platform is at your own risk and You shall be solely responsible for any losses connected thereto. You agree that A1QuicK at no point shall be liable for any claims/damages incurred by You with respect to Your usage of Platform.
In respect to Your use of Platform, you hereby confirm and acknowledge that:-
You shall be responsible for maintaining the confidentiality of Your login details to be received by A1QuicK after receiving requisite permissions (“User Account”) for restricting unauthorized access of Your User Account. You agree that You will not allow any third party to use Your User Account for any purpose.
A1QuicK disclaims all and/or any liability that arises because of any act, omission or in connection to Your use of the Platform and/or any person authorized by You using the Platform.
You cannot access Your User Account on multiple mobile devices at the same time.
You undertake not to host, display, upload, modify, publish, transmit, update or share any information which:
belongs to another person and to which You do not have any right;
is grossly harmful, harassing, blasphemous, defamatory, obscene, pornographic, paedophilic, libelous, invasive of another’s privacy, hateful, or racially, ethnically objectionable, disparaging, relating or encouraging money laundering or gambling, or otherwise unlawful in any manner whatever;
harms minors in any way;
infringes any patent, trademark, copyright or another proprietary/intellectual property right;
violates any applicable laws for the time being in force;
deceives or misleads the addressee about the origin of such messages communicates any information which is grossly offensive or menacing in nature;
contains software viruses or any other computer code, files or programs designed to interrupt, destroy or limit the functionality of any computer resource;
threatens the unity, integrity, defence, security or sovereignty of India, friendly relations with foreign states, or public order or causes incitement to the commission of any cognizable offense or prevents investigation of any offence or is insulting any other nation;
is misleading or known to be false in any way;
Your access to the User Account and/or permission granted by A1QuicK for using the Platform shall be terminated on immediate basis under the following circumstances:
If You are not associated with A1QuicK either in employment or otherwise;
If the requisite permissions basis which You had been provided access of the Platform are revoked;
Any unauthorized use of Your User Account;
Any information/data that You provide on the Platform will be governed by the privacy policy of A1QuicK available at https://A1QuicK.com/privacy.
All information contained on the Platform (unless otherwise indicated), including but not limited to videos, text, graphics, logos, icons, audio clips, writings, images etc. is copyrighted by and proprietary to A1QuicK, and may not be copied, reproduced, transmitted, displayed, distributed, altered, modified, stored for subsequent use, or otherwise used in whole or in part in any manner without A1QuicK’s prior written consent.
A1QuicK reserves the right to make any changes to the Platform and/or these Terms at any time without notice. You agree that it is Your responsibility to monitor the changes made to the Platform. Your continued use of the Platform indicates Your acceptance of these Terms and any change that may be made to these Terms from time to time.
You agree to use the Platform provided by the A1QuicK for lawful purposes only and comply with all applicable laws and regulations including the confidentiality of information available/shared while using/accessing the Platform.
You will provide authentic and true information in all instances where any information is requested by you from A1QuicK. A1QuicK reserves the right to confirm and validate the information and other details provided by You at any point of time.
These Terms shall be governed by applicable laws. The courts of New Delhi shall have exclusive jurisdiction to adjudicate over any dispute arising from these Terms.
Disclaimer of Warranties: You acknowledge and agree that the Platform is provided "as is" and "as available" and that Your use of the Platform shall be at Your sole risk. to the fullest extent permitted by applicable laws, A1QuicK, its affiliates and their respective officers, directors, employees, agents, affiliates, branches, subsidiaries, and licensors ("A1QuicK Parties") disclaim all warranties, express or implied, in connection with the Platform and Your use of them. To the fullest extent permitted by applicable laws, the A1QuicK Parties make no warranties or representations about the accuracy or completeness of the Platform and assume no responsibility for any (i) errors, mistakes, or inaccuracies of information, (ii) personal injury or property damage, of any nature whatsoever, resulting from Your access to and use of the Platform, (iii) any unauthorized access to or use of our servers and/or any and all personal information stored therein, (iv) any interruption or cessation of transmission to or from the Platform, (v) any bugs, viruses, trojan horses, or the like which may be transmitted to or through the Platform through the actions of any third party, (vi) any errors or omissions for any loss or damage of any kind incurred as a result of the use of any emailed, transmitted, or otherwise made available via Platform. Any material downloaded or otherwise obtained through the use of Platform is done at Your own discretion and risk and You will be solely responsible for any damage to Your mobile device or other device or loss of data that results from the download of any such material.
Indemnification: You agree to indemnify, defend, and hold harmless the A1QuicK Parties from and against any claims including third party claims, damages (actual and/or consequential), actions, proceedings, demands, losses, liabilities, costs and expenses (including reasonable legal fees) suffered or reasonably incurred by us arising as a result of, or in connection with: (i) Your unauthorized use of the Platform ; (ii) Your access to and use of the Platform; (iii) any injury or damage to or claim raised by any person (including third party and customer), due to Your acts or omissions (including negligence, deficiency in performance of Your services or misconduct); (iv) any action taken by any regulatory/ governmental/ administrative/ judicial authority, including challans, penalties imposed for breach of applicable law; (v) Your breach of these Terms, including, but not limited to, any infringement by You of the copyright or intellectual property rights of any third party. We retain the exclusive right to settle, compromise and pay, without Your prior consent, any and all claims or causes of action which are brought against A1QuicK Parties. We reserve the right, at Your expense, to assume the exclusive defense and control of any matter for which You are required to indemnify A1QuicK Parties and You agree to cooperate with A1QuicK’s defense of these claims. You agree not to settle any matter in which We are named as a defendant and/or for which You have indemnity obligations without A1QuicK’s prior written consent. We will use reasonable efforts to notify You of any such claim, action or proceeding upon becoming aware of it.
